Mobile Information Sharing — Our Commitment
Texas Auto Mart will not share, sell, or transfer mobile information (phone numbers, SMS opt-in data, consent records, or message content) to any third parties or affiliates for marketing or promotional purposes at any time. All mobile messaging opt-in data and consent records are kept strictly confidential and are not shared with third parties under any circumstances.
1. Scope of This Policy
This SMS Privacy Policy applies to the Texas Auto Mart SMS program operated by Texas Auto Mart ("we," "us," "our"), a Buy Here Pay Here automobile dealership located at 4906 Rigsby Ave, San Antonio, TX 78222. It governs how we collect, use, and protect information from individuals ("you") who opt in to receive text (SMS) messages from us.
2. Information We Collect
When you opt in to receive SMS messages from Texas Auto Mart, we collect:
- Your mobile telephone number
- Your first and last name (provided on the credit application)
- The date and time you provided consent
- The method by which you provided consent (online checkbox)
- The IP address from which you submitted the credit application (for fraud prevention)
- Content of messages exchanged with us
3. How We Obtain Your Consent (Call to Action)
You provide express written consent to receive SMS messages from Texas Auto Mart by completing the online credit application at apply.texasautomart.net.
Immediately above the application's Submit button, in a section titled "Text Message Notifications (Optional)," is an unchecked checkbox that reads:
The checkbox is not pre-checked and is not required to submit the application. Checking this box and submitting the application constitutes your express written consent to receive SMS messages from Texas Auto Mart.
4. How We Use Your Information
Your mobile information is used solely to send transactional and customer care SMS messages related to your relationship with Texas Auto Mart. Specifically:
- Payment reminders for financed vehicles
- Past-due notifications when an account becomes delinquent
- Insurance lapse warnings when proof of full-coverage insurance has not been received
- Promise-to-pay confirmations after a customer arranges a future payment
- Customer care responses when you initiate a conversation with us
- Sales follow-up when you have visited the lot and submitted contact information
We do not use mobile information for marketing or promotional purposes outside the SMS program described above.
5. Mobile Information & Third Parties
Texas Auto Mart will not share, sell, or transfer mobile information (phone numbers, SMS opt-in data, consent records, or message content) to any third parties or affiliates for marketing or promotional purposes at any time.
Specifically:
- We do not sell mobile information to any third party.
- We do not rent, lease, or transfer mobile information to affiliates, marketing partners, lead-generation services, or other third parties.
- SMS opt-in records and consent data are never shared with any third party.
- The only third party that receives your mobile number is our SMS messaging service provider (currently Twilio), which transmits messages on our behalf and is contractually prohibited from using your data for any other purpose.
6. Message Frequency
You will receive up to 4 messages per month from Texas Auto Mart, depending on the status of your account. Message frequency may be lower for customers in good standing and slightly higher (but still capped at 4/month under normal operation) during periods of past-due collection.
7. Message and Data Rates
Message and data rates may apply. Check with your wireless carrier for information about charges that may apply for SMS messages, including any international charges.
8. Opt-Out
You may opt out of the SMS program at any time. To stop receiving messages, reply STOP to any message you receive from us. Alternative opt-out keywords accepted: OPTOUT, CANCEL, END, QUIT, UNSUBSCRIBE, REVOKE, STOPALL.
After you opt out, you will receive one final confirmation message indicating you have been unsubscribed. You will not receive further SMS messages from the program unless you re-subscribe by replying START.

10. Data Retention
We retain SMS opt-in consent records, message logs, and opt-out records for as long as required by federal and state telecommunications recordkeeping law (currently 4 years under the TCPA), and longer where required by an active customer relationship or active financing agreement. Opt-out records are retained indefinitely to ensure we honor opt-out elections.
11. Children
The SMS program is not directed to individuals under the age of 18. We do not knowingly collect mobile information from children. If you are under 18, do not opt in to the SMS program.
12. Changes to This Policy
We may update this SMS Privacy Policy from time to time. If we make material changes, we will update the Effective Date above and, where required by law, provide notice to subscribers. Continued participation in the SMS program after the Effective Date constitutes acceptance of the updated policy.
